Should I take the Cleveland adjuster's offer or wait for my VA records?

With 2025 Ohio auto policy renewals driving up claim-pressure and year-end files getting pushed to close, the insurer wants you to believe take the money now is the smart move.

From the adjuster's side, the pitch is simple: your injuries are "already covered" by the VA, the offer might "go away," and waiting for records from VA or Cleveland Clinic will only slow things down. If the crash happened in bad winter visibility on I-90, SR-2, or during lake-effect snow, they may also hint liability is messy and this is the best you will get.

Reality: wait until your records and treatment picture are clear before accepting a bodily injury settlement.

Your VA benefits and your civilian injury claim are not the same system. The VA may pay for care, but that does not mean the at-fault driver's insurer gets a discount. Once you sign a release, the claim is usually over, even if later records show a concussion, back injury, PTSD flare, or future treatment needs.

In Ohio, the general deadline to sue for crash injuries is 2 years under Ohio Revised Code 2305.10. That sounds like time, but it disappears fast if you are still gathering VA records, outside imaging, and billing. End-of-year settlement pressure is designed to make you trade a short deadline for a cheap check.

Do this now:

  • Ask for the offer in writing
  • Tell the adjuster you are still treating and are waiting on VA and civilian records
  • Keep every explanation of benefits, mileage log, prescription receipt, and work-loss document
  • If the other driver was working, including Amazon Flex, identify all possible policies before settling

If the crash involved a storefront in Cleveland, also get the police report and any building or business surveillance quickly before it disappears.
