Am I running out of time to use Uber insurance after a Canton crash?
The thing insurers hope you never find out is that, as an Ohio rideshare passenger, you may have more than one insurance claim available - but the clock on your injury claim is still running.
Most people assume they have to wait until someone decides whether the Uber driver, another driver, or winter road conditions caused the crash. That is not how it works in Ohio.
If you were hurt as a passenger in Canton, you can usually make claims against any driver whose negligence contributed, and Uber's coverage can apply while you were in the ride. When a passenger is in the vehicle, rideshare companies typically carry up to $1 million in liability coverage. You do not have to pick just one policy at the start.
What people also get wrong: they think the deadline is just "whenever insurance finishes investigating." In Ohio, the usual deadline to file a lawsuit for bodily injury from a crash is 2 years from the date of the wreck under Ohio Revised Code 2305.10. Miss that, and the claim can be barred even if you were clearly hurt.
The practical difference is huge: do not wait for insurers to sort out fault from a black-ice pileup on I-77 near Canton or a chain-reaction winter crash tied to poor visibility. Open the claims now and protect the lawsuit deadline separately.
Act fast on these items:
- Get the crash report from Canton Police Department or the Ohio State Highway Patrol if they investigated.
- Report the crash through the Uber app immediately.
- Identify every vehicle involved, especially in multi-car winter crashes.
- Keep records of ER visits, imaging, ride receipts, and missed work.
- Do not assume the driver's personal insurer is the only coverage.
The right most passengers miss is this: in Ohio, you can pursue coverage before fault is fully sorted out, but you cannot let the 2-year filing deadline slip.
